Colorado’s new maintenance formula

Colorado’s new maintenance law (also commonly referred to as alimony) went into effect on January 1, 2014. The Colorado court’s will apply the following formula in determining an award of maintenance:

1. The combined incomes of the parties are less than $240,000.00 annually.

2. The parties have been married for at least three years.

3. The monthly amount to be paid is determined by taking 40% of the monthly gross income of the higher earning spouse minus 50% of the monthly gross income of the lower earning spouse.

4. The duration of the maintenance award is determined by the length of the marriage.
